Terms and Conditions 

Riviera Travel, LLC, a Florida Limited Liability Company dba Riviera Cruises, (“Riviera”, “we”, or “us”), is a tour operator offering incredible holiday experiences from relaxing ocean cruises to jam-packed European tours. The term “you”, “your” and/or “traveler”) refers to all persons named on the confirmation form (Booking Party) (including those added or substituted at a later date).  

Thank you for selecting Riviera Travel as your tour operator for your trip. To ensure you understand the terms and conditions, including all brochures, documents, correspondence and the terms and conditions of our supplier(s) form the basis of the contract with you. Riviera Tours Limited terms and conditions apply to the entirety of your river cruise and to any included excursions but do not apply to any other accommodation, flights or other services booked in addition to the cruise as advertised in our brochure. Before making a booking with us, you must ensure that you have read and understood these terms and conditions. Please be aware that these terms and conditions contain waivers of liability as well of waiver of class action and venue selection and notice clauses. By asking us to confirm your booking, you are accepting all of the terms and conditions laid out below and acknowledging that you have read the terms and accept the terms of this contract. 

If you are making a booking as a group, the leader of the group is responsible for sharing these Terms and Conditions with all members of the group and is financially responsible for the booking.  We will not be liable for a group leader’s failure to share these Terms with all travelers in their group. 

You represent and warrant that (a) you are 18 years of age or older, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. 

You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) you being denied access to the applicable travel related product or service. 

Riviera reserves the right, in our sole discretion, to change these terms and conditions at any time. Updated versions of the terms and conditions will be posted on our website and are effective immediately on posting. If we make material changes, we will notify you. Please check frequently, especially before you make a booking, to see if these terms and conditions have changed. Your continued use of our services including continuing to use or maintain any bookings after any changes to the terms and conditions constitutes your consent to the changes. 

Your Booking Conditions

When you are ready to start your next cruise journey, simply contact us either by email, phone or via one of our authorized travel agents to confirm availability. If available, clients will be sent an email with the Terms and Conditions and payment information.   

We will confirm your booking and send confirmation upon receipt of the initial deposit or if you so choose payment in full. After booking, you will receive your itinerary, an invoice with payment information and/or installment information and other important travel information. The invoice will contain a breakdown of the elements of your booking and your non-refundable deposit. The invoice can either be paid in full upon receipt or in installments as described in the invoice.  

A non-refundable deposit of $600 per person must be paid to confirm your booking. A client’s booking is NOT complete until the client’s non-refundable deposit payment clears.  

This invoice is subject to change until you receive confirmation that your travel is booked. The balance of the payment is due one hundred and one (101) days before the departure date, or at time of booking if the departure date is within one hundred and one (101) days.  

We reserve the right to return your deposit and decline to issue confirmation at our absolute discretion. When you book through one of our authorized travel agents, the booking confirmation letter/invoice and all other communications will be sent to your agent and you should also contact us through the agent. 

Upon booking, we will provide you with instructions for payment.  You must make all payments in full and on time.  If payments are not received when due, we reserve the right to cancel your participation in the tour and apply the cancellation charges set out in the cancellation section below. Failure to make a payment may result in the cancellation of your reservation.  In such a case this would be considered a cancellation by you and the cancellation terms and fees as described below would be in effect. 

The price of your itinerary will be based on known costs at the date of issue of the itinerary.  All prices we advertise are accurate at the date published, but we reserve the right to change any of those prices from time to time. Prices include a cost for local taxes that are estimated at the date of publication.  At the time of booking confirmation, we will provide you with an invoice reflecting the current price. 

Prior to final payment, we reserve the right to add a supplement to your invoice should our costs of supplying your travel increase as a result of changes by our suppliers, dues or taxes payable locally, currency fluctuations and government action.  If such increase occurs, we will forward a new Invoice reflecting any changes. If the prices fluctuates more than 25% from the original invoice, client may cancel and receive a refund, less the non-refundable deposit.  

We reserve the right to make changes to and correct errors in advertised prices at any time before your travel is confirmed.  We will advise you of any errors of which we are aware and the current applicable price at the time of booking. 

 

Once confirmed, your deposit is non-refundable. 

If you choose to cancel, we must receive written notice of said cancellation either via certified mail, overnight courier, or e-mail sent to [email protected] (with a confirmation of receipt from us).  

  • Since we incur costs in cancelling your arrangements, you will be required to pay the applicable cancellation charges up to the maximum shown below. The amount of the cancellation fee depends upon the date when the written notice of cancellation is received by us.  You can see the detail here: https://www.rivierarivercruises.com/company-policies/booking-conditions. 
  • 100% cancellation fee for no shows or if cancellation is made after travel is scheduled to begin 
  • Riviera charges a $20 administration fee on all cancellation and changes, including name and date changes.  
  • No refund for unused portions of the trip. 

Furthermore, you acknowledge that some parts of the vacation may be operated by a third party and are subject to other deposit requirements, cancellation fees and terms and conditions that may vary from the changes/cancel fees stated above. 

If a flight, rail, or other delay for any reason prevents you from joining the Cruise on the scheduled start date, you will be considered a no-show, and we cannot provide a full or partial refund or credit toward a future cruise, but you may join the cruise late if you wish, provided you contact Riviera prior to the start of the cruise. Additional costs of joining the cruise late, including alternative transportation charges, are the sole expense of traveler. Supplier cancellation fees may be assessed in addition to the change/cancel fees stated above. 

We strongly recommend you purchase a travel protection plan to help protect you and your travel investment against unexpected delay or interruption. Travel protection plans include coverage for trip cancellation, trip interruption, emergency medical and emergency evacuation/repatriation, trip delay, baggage delay and more. Travel insurance is available through third-party travel insurance companies, and limits vary by insurer and policy purchased. Insurance will cover most losses, but coverage may vary. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. If you choose to travel without adequate travel protection insurance coverage, we will not be liable for any of your losses howsoever arising, for which an appropriate travel protection insurance policy would otherwise have been available. You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide or tour manager. The decision of the local guide, tour manager or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the tour, Riviera or the local guide/tour manager/supplier has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) who it determines to detract from the comfort, convenience or safety of the tour participants  including if your behavior is deemed to cause or be likely to cause danger, distress or annoyance to other passengers or if we reasonably determine your condition would adversely affect your health, safety or enjoyment or that of other passengers. If we remove you from a trip in progress you will not be entitled to any refund, payment, compensation or credit of any kind for unused or missed services or costs incurred resulting from the termination of the travel arrangements and you will be responsible for your travel costs to return back home. 

No weapons of any type are permitted on Riviera vacations at any time. This includes, but is not limited to, firearms, knives, mace, brass knuckles, and other weapons of any type. 

Children under 12 years old at the date of departure are not allowed on any of its ships. Additionally, we reserve the right to limit the number of children on any trip. Any minor must be accompanied by and share a cabin with an adult aged 21 or over. If the adult is not the minor’s parent, a “Parental Consent Guardianship Form” must be signed by a parent or legal guardian prior to sailing. 

Our ships do not have doctors or facilities to deliver babies or provide-natal treatment. We recommend that women who are less than 12 weeks pregnant seek medical advice prior to travel. For safety reasons, women past their 24th week of pregnancy at any stage of the cruise cannot be carried on board. Airlines also have restrictions. Pregnant women are required to produce a fitness to travel certificate based on the proposed cruise itinerary and transport provider’s requirements. The carrier expressly reserves the right to refuse passage to board to any passenger who appears to be in an advanced state of pregnancy and the carrier shall have no liability whatsoever in respect of either such refusal and/or the carriage. 

At time of reservation, you must report to Riviera any special needs while on tour. Passengers with reduced mobility or disability or who need assistance dogs should at the time of booking provide as much detail as possible of the matters set out on our principal’s website at www.rivierarivercruises.com/reducedmobilityinformation.  

Riviera will make reasonable attempts to accommodate special needs and disabilities, but is not responsible in the event it is unable to do so nor responsible for any denial of services by rail carriers, air carriers, hotels, restaurants, or other independent suppliers. Riviera does not provide personal services (such as pushing a wheelchair, assisting with walking, moving or assembling mobility equipment etc.) and Riviera does not provide individual assistance to a vacation participant for walking, dining, getting on and off cruise ships, coaches, trains, and other vehicles, or other personal needs. A qualified and physically able companion should accompany travelers who need such assistance. 

In the event you fail to notify Riviera at the time of the reservation of any special needs or disabilities requiring special attention, Riviera reserves the right to cancel your booking or terminate your vacation in its sole discretion, if your special needs or disabilities are not suitable for the vacation, pose a threat to the health and safety of other participants or Riviera staff, or if you are not traveling with a companion who provides all the assistance you require. Riviera will not refund or cover any costs or expenses incurred for cancellation, booking, or termination of the vacation. Standard cancellation penalties as applicable to your vacation shall apply. 

Not all sightseeing stops/sites, transportation, hotels, lodges and other components of your vacation are accessible for people with special needs or are required to comply with the Americans With Disabilities Act (ADA), and some locations and sightseeing activities require extensive standing, sitting, climbing stairs, or walking-sometimes on unpaved or cobblestone streets. Riviera will not refund or cover any cost or expense incurred for any missed activities due to a participant's inability to fully participate with the group. The ADA is only applicable within the United States, and facilities for disabled individuals are limited outside its borders. Please be aware that there are no wheelchair accessible cabins on any of the ships. Most transportation services, including the touring motorcoaches, are not equipped with wheelchair ramps. 

If you have any food allergies which may cause significant health issues, you must report this in writing at the time of booking or as soon as convenient. It is your responsibility to ensure that you actively avoid any food you are allergic to and make all appropriate enquiries to establish the ingredients of any food. The supplier is not under any obligation to prepare or provide special meals. 

If you are unable to authorize your own medical attention and treatment, you authorize us or our subcontractors or agents to authorize medical attention and treatment on your behalf. You agree to hold harmless and release us or them from any liability for medical attention authorized by us or them on your behalf. We assume no liability regarding provision of medical care or evacuation services. Any of our staff or subcontractors who may provide or seek emergency medical care on your behalf may not have had formal medical or first aid training and are acting only as a Good Samaritan.

We reserve the right to cancel or postpone the Tour for reasons beyond our control including any event named in the Risks of Travel section below. You may transfer your booking to a later date or we will provide you with a future travel credit (FTC), for some or all monies you paid to us, toward a future Tour arranged by us during the 18-month period after we notify you of the postponement or cancellation. 

If we cancel or postpone your Tour and you choose to transfer your booking, the new Tour will be subject to the terms and conditions of this agreement based on your original travel date. If the alternative date is lower, we will refund the price difference as a Future Trip Credit (FTC) voucher.  If the alternative date is higher, you will be responsible for the increase in price. 

If, for reasons beyond our control including any event named in the Risks of Travel section below, a Tour in progress must be interrupted or cancelled, we will, at our sole discretion, provide you either an FTC or refund in the amount of the refund we receive from our suppliers. 

Except as set forth in this section we will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever including expenses incurred by you for arrangements made independently of Us such as airline, hotel, excursion and travel insurance charges.  

We reserve the right to cancel or reschedule any departure for any reason. If we cancel, except in the case of a force majeure event, we will offer alternate arrangements.  We may at our sole discretion offer travel vouchers or refunds in accordance with the cancellation schedule above.  You are responsible for any additional costs for air tickets or other travel arrangements not made by us. 

If between planning time and/or during actual travel, circumstances require changes, Riviera and its suppliers, reserve the right to cancel or vary any itinerary, including canceling or changing the port and substitute components of any tour, including but not limited to hotels and accommodations of comparable quality, if air schedule or surface transportation charges, security matters, and/or other events make such alterations necessary. Suppliers may substitute transportation equipment depending on any variety of factors, including the volume of passengers on the tour. Sightseeing Tours may be altered as described above. Riviera cannot be held responsible for any closures, necessary itinerary changes, or curtails for any reason. These changes will not be considered material changes and will not be considered cause for cancellation by the traveler. Normal cancellation penalties still apply to the tour that has been changed. 

Cruise ship travel, as well as other forms of transportation, is subject to delays and service disruptions. Riviera is not responsible in whole or in part for any delays, delayed departures or arrivals or missed carrier connections or for the loss of any purchased services that cannot be used as the result of delays or service disruptions. Riviera strongly encourages purchasing travel insurance against trip delay and trip interruption. 

You are responsible for providing and verifying full, complete and accurate information for all participants and services at the time of reservation. Under no circumstances are We liable for any errors or omissions in the information provided by you to complete the reservation. If you do not notify Riviera of any error within 10 days of making the reservation, you are solely responsible for all fees assessed due to incomplete, erroneous or inaccurate details. Prices are subject to change without notice, and all reservations are based on availability. Prices listed are quoted in U.S. dollars, per person. 

Advertised promotions are not retroactive to existing bookings. 

Transportation services do restrict the size of baggage along with the weight. Information on baggage is available upon request from Riviera. You are responsible for complying with transportation service baggage restrictions. 

Tour prices do not include gratuities, baggage handling, excess baggage charges, fuel surcharges, items of a personal nature, items not specified as included in the itinerary description, and all other incidental charges.  

All amenities shown for a particular hotel property may not be available in every room category. Special room requests, including bedding requests, will be communicated to the applicable party but cannot be guaranteed. 

In the event of a technical or clerical error in a published price, service or feature, Riviera reserves the right to cancel your reservation and provide a refund for your reservation, including after your reservation is confirmed. 

Traveler hereby gives consent to Riviera to publish any photographs and/or videos of the trip or Traveler in printed or electronic media without obtaining further consent and without compensation. Each Traveler releases Riviera and its representatives from any liability in connection with any use of such photographs and/or video.

The information that you provide to us will be passed on to the relevant suppliers of your travel arrangements or other persons necessary for the provision of your travel arrangements. The information may also be provided to public authorities such as customs or immigration if required by them, or as required by law. This may include any special category (sensitive) information that you give to us such as details of any disabilities, or dietary and religious requirements. In making this booking, you consent to this information being passed on to the relevant people. Certain information may also be passed on to security or credit checking companies. If you are travelling to the United States, the US Customs and Border Protection will receive this information for the purposes of preventing and combating terrorism and other transnational serious crimes. If you travel outside the European Economic Area, controls on data protection may not be as strong as the legal requirements in the EEA or UK. If we cannot pass this information to the relevant suppliers, we will be unable to arrange your booking. 

Travel to certain destinations may involve greater risk than others. Riviera urges Travelers to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, and http://www.cdc.gov. In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country, including COVID- 19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. It is your responsibility to be aware of any and all requirements for admittance to a country or state, including Covid-19 requirements. Should you choose to travel to a country that has been issued a travel warning or advisory, RIVIERA will not be liable for damages or losses that result from travel to such destinations.  

It is the responsibility of each Traveler to obtain and carry a valid passport, visa(s), inoculations, and all other documents required by applicable government regulations. For up-to-date requirements US citizens should visit www.travel.state.gov. When travelling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here: http://www.tsa.gov/traveler-information/acceptable-ids. Riviera strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-USA citizens may require additional documentation. Minors also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities.  

Recommended inoculations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/ 

You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing traveler to miss flight(s), and subsequent scheduled travel bookings tours.  Riviera bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry. 

We act as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, bus operator, railroads, excursion company or other service provider named in your itinerary or confirmation ("Suppliers"). We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers. We have no responsibility for car accidents caused by you or any other person or entity. 

Your airline ticket constitutes a contract between yourself and the airline, even if purchased through us. We are not liable and assume no responsibility or accept claims with regard to seat assignments, name changes, schedule changes, flight changes, cancellations, claims for refund or reimbursement of airline ticket fees, or any other loss or expense incurred by you for any reason whatsoever (including without limitation to bankruptcy, insolvency, reorganization of a carrier or similar relief from creditors) when purchasing or using the carrier’s services. The flight booking service offered by us can only be used in conjunction with a Riviera trip. Tickets and/or e-tickets will be emailed with final documents. If we make airline reservations for you, we will not change your requested seat assignments on commercial aircraft without permission. However, airlines often change seat assignments to satisfy their loyalty members or because of equipment changes (aircraft type). We are not notified of these changes in advance, and often clients are not made aware of these changes until they arrive at the airport. We are not responsible for seat assignment changes made by the airline. Frequent flyer programs are private agreements between airlines and passengers, and we cannot be held responsible for mileage discrepancies involving airline loyalty reward programs. Some governments charge departure taxes and/or fees. These fees are the responsibility of each passenger traveling to the designated country and are not included unless stated. 

We are not liable for any extensions, upgrades, or extras arranged by you on arrival at any accommodation. The people named on your confirmation are the only ones allowed to use the accommodation we have arranged for you. You are not allowed to share the accommodation or let anyone else stay there. You are responsible for the cost of any damage caused to your accommodation or its content during your stay. In the event of one or more members of a party cancelling for any reason, a price increase for the remaining members may be applicable, and a new invoice may be sent to you showing the new costing and any cancellation fees involved. There may be small differences between the actual accommodation and its description. Occasionally, local conditions may mean that some facilities or services become unavailable or subject to restriction for reasons such as maintenance, bad weather or lack of demand from guests. Please also be aware that advertised facilities within your hotel and around the resort may not be fully functional in early and late season. We cannot accept responsibility for any changes or closures to area amenities or attractions. We cannot accept responsibility for any inaccurate, incomplete or misleading information about any accommodation or its facilities and/or services, except in the case of our negligence. If our principal(s) supplier(s) make us aware of any changes, we will inform you of any changes. Sometimes local laws, religious customs or events mean facilities may not always be available. Local taxes may be applicable and will be collected by the accommodation upon check-in.  

Traveler is aware that travel to such area as traveler is undertaking on the trip may involve inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, Riviera and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness,; known or unknown medical conditions, physical exertion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided. We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or contraction of or exposure to an infectious disease, bacteria or virus including COVID-19. We have no special knowledge of dangers during travel or at destinations. 

  

Traveler understands the description of these risks, is not complete and that unknown or unanticipated risks may result in injury, illness, or death.  In order to partake of the enjoyment and excitement of this trip, YOU HEREBY EXPRESSLY ACCEPT AND ASSUME FULL RESPONSIBILITY FOR ANY AND ALL OF THESE RISKS AND DANGERS AS BEING AN INTEGRAL PART OF TRAVEL, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THE TOUR OR PARTICIPATION IN ANY ACTIVITIES IN WHICH YOU PARTICIPATE, INCLUDING ANY CLAIMS OF THIRD-PARTY NEGLIGENCE AND/OR THE NEGLIGENCE OF RIVIERA. FURTHERMORE, TRAVELER HEREBY COVENANTS NOT TO SUE RIVIERA FOR ANY SUCH CLAIM OR JOIN ANY LAWSUIT OR ACTION THAT IS SUING RIVIERA. This agreement also binds your heirs, legal representatives and assigns.  The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise. 

NEITHER RIVIERA TOURS, LLC NOR ANY OF OUR EMPLOYEES, AGENTS, SUCCESSORS, ASSIGNS, SUBSIDIARIES OR AFFILIATES SHALL BE LIABLE TO YOU OR OTHER THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, REGARDLESS OF WHETHER OR NOT RIVIERA TOURS, LLC WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OUR SERVICES OR THE VACATIONS. FURTHERMORE, IN NO EVENT SHALL OUR LIABILITY WITH RESPECT TO ANY VACATION EXCEED THE FEES PAID BY YOU TO RIVIERA TOURS, LLC FOR SUCH VACATION. THESE DISCLAIMERS OF TYPES OF DAMAGES AND LIMITATIONS OF LIABILITY APPLY TO ANY DAMAGES OR INJURY, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, PRODUCT LIABILITY OR UNDER ANY OTHER CAUSE OF ACTION. BECAUSE SOME STATES DO NOT ALLOW SOME OR ALL OF THESE DISCLAIMERS AND LIMITATIONS, THE ABOVE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, DAMAGES SHALL BE DISCLAIMED AND LIMITED TO THE GREATEST EXTENT PERMITTED BY SUCH STATE LAW. RIVIERA TOURS, LLC MAKES NO IMPLIED OR EXPRESS WARRANTIES IN THE OFFERING OF ANY VACATION DESCRIBED. 

Traveler agrees to and shall indemnify and hold harmless Riviera and each of our officers, directors, employees and agents (collectively “Riviera”) from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by Riviera (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage caused by traveler while participating in the trip. 

In some cases, we are the merchant on your credit card transaction. Please bear in mind that our services consist of facilitating the sale and paying the Suppliers. If a Supplier does not provide the service or ceases operations, your recourse is against the Supplier, not us. You agree not to initiate a chargeback against us or a refund request that is not authorized by this agreement and to pay any and all legal fees incurred by us in disputing any such claim for refund. 

In certain cases, you can dispute charges with your credit card company or with your banking institution (we will define them as "chargebacks"). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Riviera retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims: 

  • Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used. 
  • Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud. 
  • Chargebacks arising from inconsistency or inaccuracy regarding the supplier’s product description. 
  • Chargebacks resulting from force majeure or other circumstances that are beyond the control of Riviera or the Supplier. 
  • Chargebacks resulting because you do not agree with the cancellation policy. 

You agree that you will only bring claims against Riviera in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. Riviera shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Riviera unless you have first provided a typewritten notice of claim to Riviera within 30 days after the trip or cancellation of the trip. 

This agreement is governed by the internal substantive laws of the State of Florida, without regard to its conflict of laws provisions. You agree that the courts in Fort Lauderdale, Florida will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts. 

This agreement, including any other documents, including invoices, we provide you, constitutes the entire agreement and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to Riviera. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Book early with confidence, safe in the knowledge that you'll benefit from our lowest prices. And in the very rare event we do reduce a price after you've booked, we'll automatically send you a Future Travel Voucher for the difference in value, plus an extra 25%. It’s our new (and we think you’ll agree) improved Price Promise. 

Terms and Conditions

If the price of your vacation reduces after you've booked, we’ll give you a future travel voucher for the difference in cost plus 25%. If we offer an added-value benefit or free upgrade to a vacation after you’ve booked, we will apply the same upgrade or add-on to your booking. If this is not possible for any reason, then we’ll give you a future travel voucher for the same value plus 25%. It will be at Riviera's sole discretion whether to offer a future travel voucher or added value benefit to make up the difference in cost. The Price Promise applies to the core elements of the Vacation you have booked with Riviera (including tour or cruise, flights and transfers if booked as a package, or tour/cruise only). The Price Promise is applicable to the final value payable at the time of booking, taking into account any discounts or promotions you may already have received when booking. The Vacation must be like-for-like to be eligible for the Price Promise; including date, departure airport and cabin category. The Price Promise does not apply to exclusive offers. Future Travel Vouchers may only be used on a new booking of a Rivera Travel vacation of 7 days or more, and must be redeemed by making a new booking within 12 months from the date stated on the voucher. Future Travel Vouchers have no cash value, and cannot be transferred.

To be eligible for our Quality Promise, customers must notify us of the Equivalent Vacation available at a lower price either before booking, or within 48 hours of confirming their booking. If Riviera deems the Vacation to be of equivalent quality, then we will offer a price match. To be deemed as equivalent quality, the Vacation must meet the following criteria. The destination, duration and itinerary must be the same, even if the itinerary stops are not in the same order. Inclusions (excursions, meals and experiences) must be equivalent. The departure date must be the same. Flight or rail options must be equivalent; including departure gateway, Air line/ rail provider and time of day. The Accommodation must be equivalent, in respect of location, star-rating, board basis and facilities. The Quality Promise only applies to the core elements of the vacation (including tour or cruise, flights and transfers if booked as a package, or tour/cruise only), and only applies to the base price of the Vacation - exclusive offers, loyalty benefits or promotions offering upgrades or add-ons free of charge do not apply. Evidence must be provided to Riviera via a website link to the equivalent Vacation, or an official quote provided by a licensed travel agent or tour operator within the last 48 hours. If any elements of the Vacation differ, it is at Riviera's sole discretion as to whether to price match.

To qualify you must raise your concerns with the Riviera Travel tour manager or cruise director and state your intention to take advantage of this guarantee within the first 24 hours of arrival at your vacation destination, they will endeavour to resolve any issues. If by the end of Day Two a solution cannot be reached, Riviera Travel will arrange and cover the cost for you to return to the starting point of your vacation arrangements with us from the next available location. We will also refund the total cost of your Riviera Travel vacation, although no refunds will be made for any additional costs incurred such as overnight hotels, airport travel, insurance, etc. The guarantee does not affect standard booking conditions or pre-departure cancellation policy. Valid on vacations of 8 days or more. Valid on 'land only' vacations. The guarantee will not apply where the situation is beyond our control.
